Đó là điều kiện đặc thù đối với những người thừa kế bắt buộc. Tuy nhiên, do một số hạn chế trong việc xác định các điều kiện này nên việc giải quyết tranh chấp vẫn chưa thống nhất và hiệu quả. Vì vậy, cần sửa đổi quy định pháp luật và có hướng dẫn cụ thể nhằm đảm bảo tính thống nhất khi thi hành quy định pháp luật này trong thực tiễn.
