Từ quá trình xác lập chủ quyền lịch sử khai thác đối với các quần đảo Hoàng Sa và Trường Sa thời các chúa Nguyễn ở thế kỷ XVII thông qua hoạt động của các đội Hoàng Sa và Bắc Hải; đến năm 1816, vua Gia Long của vương triều Nguyễn tiến hành chiếm hữu chính thức về mặt nhà nước đối với quần đảo Hoàng Sa thông qua việc phái đội thủy quân của triều đình Huế đi cùng đội Hoàng Sa ra xem xét và xác lập chủ quyền của Việt Nam tại đó. Sự kiện tuyên bố chiếm hữu chính thức về mặt nhà nước của triều Nguyễn đối với quần đảo Hoàng Sa từ năm 1816 đã được cộng đồng quốc tế công nhận rộng rãi thông qua nhiều ấn bản tại các nước Anh, Đức, Ấn Độ, Pháp, Bohemia, Nga, Italia, Tây Ban Nha mà không có bất kỳ quốc gia liên quan nào lên tiếng phản đối trong suốt thế kỷ XIX. Đó là những cơ sở pháp lý quốc tế vững chắc góp phần phục vụ đắc lực cho công cuộc đấu tranh bảo vệ chủ quyền các quần đảo Hoàng Sa Trường Sa nói riêng, biển đảo của Việt Nam nói chung trong hiện tại.
